Chapter 15.10 (Ordinance 3078, 2017) adopts Public Resources Code 4291–4299 and the matching state regulations for anyone who owns, leases, or maintains a building near grass, brush, forest, or other flammable land. That means keeping defensible space 100 feet out from each side of a structure, or to the property line. Fuel reduction is heaviest between 5 and 30 feet, and state regulations call for an ember-resistant zone within 5 feet. Separately, Chapter 8.08 (Hazardous Fire Areas) requires a permit for outdoor fires and spark-producing equipment in hazardous fire areas. Violating it is a misdemeanor punishable by up to $500 or six months in jail.

Defensible space rules in Calaveras County

Fire hazard zones in Calaveras County

Most of Calaveras County’s foothill and forest land is in the State Responsibility Area. There, CAL FIRE’s Fire Hazard Severity Zones set building standards and the 100-foot clearance rule, and those zones have been in effect since April 1, 2024. It creates a new fire safety chapter with requirements, including fire sprinklers, for new construction in the city’s wildland-urban interface and Very High zone. Unincorporated land also falls under the county’s own hazardous fire area rules, which require permits for outdoor fires and restrict smoking and spark-producing equipment.

Local rules and deadlines

Calaveras doesn’t have a separate weed-abatement code. Chapter 15.10, adopted in 2017, makes the state’s defensible space law (PRC 4291) county law. Structures near flammable vegetation need 100 feet of clearance, or clearance to the property line, all year. The CAL FIRE Tuolumne-Calaveras Unit fire plan splits this into a 30-foot defensible space zone and a 70-foot reduced-fuel zone.
